Il y a une différence de conditions juridiques entre ces deux types de catégorie d’enfants, notamment accentuée par la Loi du 25 mars 1896. En effet, ladite loi pose le principe que les enfants naturels ne possèdent aucuns droits de successions de leur parent sauf de le cas où les parents, plus particulièrement le père, reconnaissent l’enfant né. Ce régime a été abrogé par la Loi du 3 janvier 1972, mettant ainsi sur le pied d’égalité les enfants nés.
