Abstract
A summary of the resource.
Très présente et particulièrement nombreuse en Provence – notamment à Aix, la famille Silvecane compte quelques juristes éminents, parmi lesquels Jean-Baptiste Silvecane (v. 1630-1684), docteur en droit et avocat au Parlement de Provence, ou encore Louis Silvecane (XVIIIe siècle), avocat au Parlement de Provence.
Balthazar Debezieux (1655-1722), lorsqu’il entreprit le recueil des questions importantes (disponible en ligne) qu’il avait eu l’occasion de traiter au Parlement d’Aix, inséra les plus belles consultations contemporaines dressées par les avocats au Parlement de Provence. Parmi celles-ci, il inclut celles de son contemporain Silvecane, sans pour autant que l’on ait plus d’informations sur ledit juriste.
Dans sa préface, l’auteur retrace une histoire du droit romain depuis la fondation de la cité latine jusqu’à sa redécouverte par les premiers et plus éminents glossateurs. Les intitulés demeurent en latin, mais l’auteur s’efforce de traduire les Institutes de l’empereur Justinien, tout en les expliquant et les entrecoupant de remarques, que ce soient les siennes, ou celles d’autres auteurs tel Cujas.
